These Terms & Conditions ("Terms") are a legal agreement between you and Cadence ("Cadence," "we," "us," or "our") governing your access to and use of our website and services. Please read them carefully. If you do not agree, do not use the service.
1. The service
Cadence provides software that helps local service businesses communicate with their customers and leads - answering and following up on calls, texting back missed leads, sending appointment and review messages, and managing those conversations in one place.
2. Accounts and eligibility
You must be at least 18 years old and able to form a binding contract to use the service. You are responsible for the accuracy of the information you provide, for activity under your account, and for keeping your credentials secure.
3. SMS / Text messaging program terms
Program name: Cadence.
Program description: Cadence sends business communication text messages, including appointment confirmations and reminders, replies to customer inquiries, follow-ups to people who called or submitted a request, and review requests after a completed job.
By providing your mobile number and opting in, you consent to receive text messages related to the program described above. Consent is not a condition of any purchase.

- Message and data rates may apply.
- To opt out at any time, reply STOP. You will receive one confirmation message and then no further messages.

- Carriers are not liable for delayed or undelivered messages.

4. Acceptable use
You agree not to use the service to send unlawful, harassing, deceptive, or unsolicited messages, to violate any applicable law or carrier requirement, or to interfere with or compromise the security or integrity of the service.
5. Consent and compliance
If you use Cadence to message your own customers, you are responsible for obtaining and maintaining the legally required consent from each recipient before messaging them, for honoring opt-out requests, and for complying with applicable laws and regulations, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM, and carrier (10DLC) requirements.
6. Fees
Paid plans are billed as described at the time of purchase. Unless stated otherwise, fees are non-refundable, and you authorize us to charge your payment method on a recurring basis until you cancel. You can cancel at any time, effective at the end of the current billing period.
7. Disclaimers
The service is provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the service will be uninterrupted, error-free, or that messages will always be delivered.
8. Limitation of liability
To the fullest extent permitted by law, Cadence will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising out of or related to your use of the service.
9. Changes to these terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Continued use of the service after changes take effect constitutes acceptance of the updated Terms.
